Delhi HC Decision on Alimony: The Delhi High Court made its decision clear by rejecting the husband’s petition in a case, stating that the Domestic Violence Act does not distinguish between a woman’s first and second marriages when it comes to providing maintenance allowance to a wife living separately from her husband. The Delhi High Court ordered that the husband is legally required to support his wife, even if this is his second marriage. 

Wife Can Demand Alimony Even After Second Marriage

The ruling was based on a petition filed by the husband against the Family Court’s order directing him to pay increased alimony to his wife. In his plea, the husband stated that the woman was not entitled to alimony because this was her second marriage, and she left him of her own volition. Whereas her husband had accepted her and her children.
